Binding Arbitration is Necessary

Workers don’t just want a union, they want the contract that unions can get them.  The Employee Free Choice Act (EFCA) will not only improve the fairness of the process of forming unions, it will help workers get a contract.

  • Under current law, after successfully winning union representation about 1/3 of union organizing drives fail to get a first contract.
Out of nearly 1,600 cases closed by the Federal Mediation & Conciliation Service in 2004 45% went without a contract.
